The Rules About Age Discrimination

In California, age discrimination is taken seriously – this is why we have laws on the books for it while not all states do. In California, it is illegal to discriminate against a person over the age of 40 for their age. There are exceptions. First, the laws only apply to companies that have at least five employees. Second, it must be provable.

Learn What Qualifies as Age Discrimination

Any situation in which you are treated different due to your age than other workers, it could qualify as age discrimination. California and federal laws protect you from being discriminated against in hiring, firing, work assignments, transfers, raises, benefits, hours, promotions, training, and other terms and conditions of your employment.

Intent is Not Necessary in an Age Discrimination Case

It is often the case that an employer does intentionally discriminate against an employee for their age, such as not hiring an older application simply because the employer does not think that older people can handle technology. However, many instances of age discrimination do not involve anyone intentionally discriminating.

For example, if there is a neutral policy that happens to disproportionally affect older workers, then it can be age discrimination. Consider an employer who made a decision to lay of 10% of their employees and chose who to fire based on their salaries. If a disproportionate number of 40+ year old employees were laid off as a result, it can be age discrimination. This is known as a disparate impact case.
