The Rules About Age Discrimination

In California, age discrimination is taken seriously – this is why we have laws on the books for it while not all states do. In California, it is illegal to discriminate against a person over the age of 40 for their age. There are exceptions. First, the laws only apply to companies that have at least five employees. Second, it must be provable.

Consider an employer who made a decision to lay of 10% of their employees and chose who to fire based on their salaries. If a disproportionate number of 40+ year old employees were laid off as a result, it can be age discrimination. This is known as a disparate impact case.
