What Is Elder Abuse?

Elder abuse is defined as physical abuse, emotional abuse, sexual abuse, financial exploitation, or neglect of individuals 65 years old and above. Common examples include nursing home staff yelling at residents, hitting them, isolating them, allowing malnutrition or dehydration, or failing to treat and prevent bedsores.

Elder Abuse and Dependent Adult Civil Protection Act (Elder Abuse Act) (Welf. & Inst. Code, §15600 et seq.).  The Elder Abuse Act was enacted to provide for the private, civil enforcement of laws against elder abuse and neglect. One of the major objectives of the Act is the protection of residents of nursing homes and other health care facilities.   The statutory provisions governing elder abuse or neglect are not limited to mentally incompetent or physically impaired elders.  The Act also covers “dependent adults” which are defined as any “person between the ages of 18 and 64 years who reside in this state and who has physical or mental limitations. . .” (Welfare & Inst. Code §15610.23.)  Elder or dependent adult abuse under the Act is defined as physical abuse, neglect, or financial abuse.   Neglect may include the failure to assist in personal hygiene or in the provision of food, clothing or shelter, the failure to provide medical care for physical and emotional health needs including the prevention of bed sores, failing to protect from health safety hazards and failing to prevent malnutrition and dehydration.
