Appeal Process
We will exhaust every available remedy when fighting to get your Social Security Disability claim approved.
Has your initial application for Social Security Disability benefits been denied? Don’t give up. There are still many steps we can help you take to try to secure a favorable decision.
In many cases, all you really need to do is have your application reviewed by an experienced attorney like Perona, Langer, Beck, Serbin and Harrison. We will make sure the application is complete and error free and then submit it for reconsideration. If your application is still denied, we can request a disability hearing, which provides the opportunity to present evidence before an Administrative Law Judge. If your claim is denied at this stage, we can bring your claim before the Appeals Council.
Key Steps in a Social Security Disability Appeal
You can rely on the seasoned professionals at Perona, Langer, Beck, Serbin and Harrison to provide expert guidance through every step of a SSD appeal, doing everything in our power to facilitate a fast and favorable resolution to your case.
We start by making a formal request for an Appeals Council Review. Though the Social Security Administration has a specific form for this purpose, don’t be fooled—this form does not really provide adequate space for an effective request. We will draft a separate legal brief to point out any mistakes the Administrative Law Judge may have made and explain why their decision should be reviewed.
If the Appeals Council approves the request for a review, the Council will either decide your case themselves or schedule a new hearing before an Administrative Law Judge.
If your appeal is denied, we have one more possible option: filing a civil suit in a Federal District Court. This type of appeal is very rare, but if it is necessary in your case PLBSH can handle it. We are a member of a network of law firms that work together to tackle the toughest, most complicated cases so you can rest assured your appeal will get all the attention it deserves.
